If you are interested in a loose diamond or a piece of jewelry that is displayed on our site but it is currently shown as not available, please contact us and we can tell you if and when we will be able to provide you with that item.

Also, we carry a huge selection of diamonds, and from those, can make custom jewelry per your instructions. For example, we can set any of our diamonds into rings or ear studs, or other settings. Please contact us for assistance with any custom or special orders that you may have. Custom ordered pieces of jewelry may not be returned.

Some items displayed on our site may sell before we are able to post a sale notification. If we are unable to fulfill your order for that reason, we will notify you personally and assist you in finding another item of equivalent value. 

It is possible that, despite our best efforts, system or other errors may cause our site to display erroneous information. We reserve the right to correct all errors as they occur. Subject to applicable consumer laws, we will not honor erroneous prices, and reserve the right to cancel orders placed for any items listed with either an incorrect price or an inaccurate description. Price fluctuations in the world wide diamond and gold markets and other reasons beyond our control may cause our prices to change without notice. We apologize for any inconvenience that this may cause.

For orders shipped within the United States, all shipments are fully insured by us until they are delivered to you. For security reasons, we require a signature for all orders, regardless of any signature waivers that you may already have with FedEx. We will be happy to ship to an alternate address if you prefer, or if your billing address is a Post Office Box. If you are paying by credit card however, we must be able to verify that both addresses are on file with your credit card company.

Sales Tax

We charge sales tax on all orders with a shipping address in Minnesota.

Returns

We wish you to be completely satisfied with your purchase. Subject to §1 ("Special & Custom Orders") and §7 herein ("Comparison Shopping"), we offer you a risk-free 30-day return policy. The item should be returned in its original condition, and be accompanied by all of its original documentation. Please read our Return Policy and Procedure. Your account will be credited once the return package has been received by us and examined by one of our gemologists. PLEASE NOTE: Each of our diamonds is accompanied by a Diamond Certificate prepared by an independent diamond grading laboratory, and which states the unique specifications of your diamond. Replacing a certificate is a lengthy and costly process. Every return must be accompanied by its original Diamond Certificate, or we will charge you a replacement fee.

We do not permit customers to buy numerous items with the intention of keeping the one they like best. This results in unnecessary re-stocking and other costs to us, and we reserve the right to charge a re-stocking fee in the case of individual instances of abuse of this policy. We are fully committed to purchasing our diamonds through legitimate channels, and supporting the Kimberley Process. NetCarats sources its diamonds from the diamond manufacturers of Israel, Belgium, and India that are in compliance with the Kimberley Process.

UNDER NO CIRCUMSTANCES SHALL NETCARATS, INC. BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN THE EVENT NETCARATS, INC. IS NOT ABLE TO DELIVER THE PRODUCT ORDERED, YOUR SOLE REMEDY WILL BE TO CANCEL THE ORDER WITHOUT CHARGE UPON YOUR RETURNING TO US-IN GOOD CONDITION-ANY NON-CONFORMING GOODS THAT WE HAD DELIVERED TO YOU.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO SOME CUSTOMERS. IN NO EVENT SHALL NETCARATS' TOTAL LIABILITY TO A USER FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT PAID BY THAT CUSTOMER of NETCARATS FOR THE PRODUCT ordered by that customer.

Netcarats.com is intended for personal use by individuals. Netcarats reserves the right, in its sole discretion, to ban or block access to any user. Any unauthorized commercial use of Netcarats or resale, repurposing, or reproduction of Netcarats content is expressly prohibited. This includes providing links to specific content related pages other than our home page for any commercial purpose that has not been specifically authorized by us in writing as well as using the site to contact other users for commercial purposes. You agree not to bypass any authentication and security mechanisms maintained by Netcarats or reverse engineer the software on this Web site.

We reserve the right to amend this Agreement and other site guidelines or rules at any time. Any amendment shall become effective immediately upon posting to NetCarats.com. You shall be responsible to check this Agreement from time to time to see if there are any amendments that may affect your use. Continued use of NetCarats.com after any amendment constitutes acceptance of all amendments. If you do not agree with this Agreement in full at any time, you should immediately terminate your use of this site.

Interpretation and enforcement of this Agreement shall be governed by the laws of the State of Minnesota, excluding its choice of law rules. All users consent to personal jurisdiction in the federal and state courts of the State of Minnesota, for any action arising out of or relating to their use of the Services. The federal and state courts of the State of Minnesota shall have exclusive jurisdiction over all such actions.

If any provision herein is held to be invalid or unenforceable for any reason, the remaining provisions shall be unimpaired. This Agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof, and supersedes in their entirety any and all written or oral agreements previously existing between the parties with respect to such subject matter. Failure by Netcarats to enforce any provision of this Agreement shall not be construed as a waiver of any provision or right.
